1. Scope
These General Conditions of Participation apply to the MANDALA's profit games. Each participant recognizes these terms and conditions by participating in the competition. The competitions are no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. The organisers decision is final.

3. Participation
3.1.Each natural person of minimum age of 18 years may participate in his / her own name. Participants who have already reached the age of sixteen, but are not yet 18, are allowed to participate in the competition only with the consent of the educationally entitled persons. Non-active employees as well as employees of MANDALA are excluded from participation.
3.2. The organizer reserves the right to exclude persons from the participation who violate these conditions or who procure or wish to procure an advantage over other participants by inadmissible influence or manipulation of the contest. In such cases, the organizer can also exclude participants from the prize list, the deprieve the win and reclaim them.
3.3. The participation is only possible within the time limit stated in the lottery description. Each participant may participate only once in an identical competition.
3.4. Only the costs for the connection to the Internet are incurred. Additional costs do not arise. In particular, participation is not dependent on the purchase of a product or the use of a service.
4. Facebook & Instagram competitions
4.1. A prerequisite for the participation in the contest is a commentary on the Facebook or Instagram presence of the organizer or the posting of a photo on the Facebook presence of the organizer. The precise procedure of the actions to be taken is described on the lottery play participation side. If a further prerequisite for the participation in the competition is necessary, it is communicated directly under the conditions of a possible participation in the competition. The prize draw will be carried out during the aforementioned time period. All participants will be considered, who have qualified according the conditions, as listed in points 2 and 3 during the specified time frame.
The winner will be selected, immediately after the expiration of the participation period, on a random basis.
4.2. A cash payment of the prize and an exchange of the prize are excluded. The claim for a prize is not transferable.
5. Prize Settlement
5.1. The winner will be notified by e-mail or electronically (via Facebook or Instagram) by the organizer. With regard to the prize, each participant thus informed shall be obliged to notify the organizer with the acceptance declaration, within 14 days after the notification has been. If the organizer does not receive a corresponding message within this period, the possibility of accepting the prize will be forfeited and the organizer reserves the right to ascertain and notify another participant.
5.2. Should the by the participant given contact possibilities be incorrect (e-mail address for example), the organizer is not obliged to determine the correct data. The disadvantages arising from the provision of faulty contact data (for example a faulty e-mail address) are at the expense of the participant.
6. Liability for Defects
The organizer is only liable for damages caused to the winner due to material and / or legal deficiencies in case of malice, intent or gross negligence. Otherwise, a liability for material and / or legal deficiencies is excluded.
7. Earlier termination, Disclosure and Revocation,
7.1. MANDALA reserves the right to terminate the competition at any time without prior notice and without giving reasons. This shall apply in particular if proper performance can no longer be ensured for technical or legal reasons. The participants are not entitled to any claims against MANDALA in such a case.
7.2. MANDALA reserves the right to exclude participants from participating in the contest. This applies in particular to violations of the conditions of participation or if a participant tries to manipulate the game or to use dishonest tools. MANDALA can also pronounce such an exclusion at a later stage, denounce the prize and reclaim them, if the reasons of exclusion are discovered later.
8. Data protection
In order for the competition to be carried out, MANDALA must know personally identifiable information about the winners, such as names and e-mail addresses. Personal data which are transmitted to MANDALA as part of the participation in the competition are only stored, processed and used by MANDALA for the execution and processing of the lottery. A transfer of data to third parties does not take place.
9. Intellectual property / rights of use / exemption agreement
9.1 The participant assures that all pictures published by him do not violate the rights of third parties and that the participant alone is entitled to dispose of the rights to the published pictures unrestricted and free of third party rights. The participant also declares that he has not taken and will not take in the future any action or commitment, that are contrary to these conditions of use.
9.2 The participant grants the organizer, with regard to the published pictures, a temporally and regionally unlimited, simple right of use with regard to all types of use for the publication on the Facebook page as well as on the website www.mandala-fashion.com. Furthermore, the organizer is granted the right to issue simple sublicenses. In addition, the organizer is entitled to a processing right to the pictures submitted by the participant that the organizer is entitled to edit and / or convert the template using analog, digital or other processing facilities, while respecting the copyright law.
9.3 If the participant violates the copyrights, commercial property rights, license rights or other proprietary rights of a third party, the participant is obliged to release the organizer from all the legitimate claims of the third party from the infringement in full. The participant is also obligated to bear the costs of the necessary legal defense including all legal and court costs. This does not apply if the infringement is not the responsibility of the participant.
10. Safeguard Clause
Should a provision of the terms of participation be or become invalid, the validity of the remaining provisions shall remain unaffected. Instead of the invalid or missing provisions, the respective legal regulations apply.
11. Applicable law
The competition is subject exclusively to the law of the Federal Republic of Germany.
